Process service is not a common industry. In fact, unless you find yourself in a certain situation where you actually need a process server, it’s possible that you won’t ever meet one or even hear about them. But if you do require one, it’s important that you at least know what to do to find one that is reliable. After all, like any other industries, there are does that do an exceptional job and then there are those who bring more trouble than help.
So if you’ve never had to hire a process server, what can you possibly ask one to know if he is the right server for your case? To ensure success, you can ask these questions:
Does the person have to personally take my papers for him or her to be served? What’s going to happen if they don’t answer the door?
Any process server worth his salt should be able to comprehensively explain how this type of situation is handled. If the server you are talking to cannot give you a straight answer, find a better one! It is highly important to hire a process server who is knowledgeable in the law and has vast experience in the field.
Will you also file the proof of service form with my court? Will you charge an additional fee for this?
Unless you want to do so yourself, taking that extra trip to file the proof of service can be a hassle, especially if you would have to skip work to do it. Save yourself the trouble and find a server that includes the filing of the proof of service form with the court for you. Note, however, that there are servers who would ask for an additional fee for this task so make sure that you ask.
Do I have to pay you up front or do you accept payments after the work is done?
You might encounter a process server who will require you to pay up front – if you do, find out how you can be sure that they will still be motivated to get the job right and on time if they already have your payment. You might also find a server who will tell you that it’s up to you. In this case, of course, you should choose to pay once the service is completed. Then there are those of us who will only accept payment after the job is done.
How much exactly do I have to pay for the service? Is this a flat rate or should I expect additional fees?
We cannot express enough the importance of agreeing to a specific price before you hire a process server. You should also make sure that you have a clear understanding of what you get for that fee. For instance, ask if you are paying for unlimited number of attempts. Find out how much you have to pay in addition if the person has moved to a different area.
The last thing you want to deal with when you have a case filed is a process server who can’t do his job right or one whose fees are way too high for what has to be done. Like in any other industry, it will do you good to do your homework and make sure that you are hiring the right person to do the job.
You can also entrust the job to a reputable company like Select Document Services Inc. With our experience and dedication to accurate and timely process service, you won’t have to worry about your legal documents.
